- Scope and Eligibility
These Terms apply to all contracts concluded between ANIMA Garden GmbH and customers residing within the European region.
By placing an order, you confirm that you are acting as a consumer and are legally capable of entering into binding contracts under applicable European laws.
- Shipping, Delivery, and Risk of Loss
Dispatch Location: All orders are dispatched from our warehouse facility located in Germany.
Logistics Partners: We collaborate with reputable premium shipping carriers, including DHL, FedEx, and UPS Priority services.
Processing Time: Orders are processed and prepared for shipment within 1 to 2 business days following order confirmation.
Estimated Delivery Window: Standard transit times across the European region generally take between 5 to 7 business days.
Tracking Notifications: Automatic updates will be sent to the email address provided at checkout during key transit milestones, including order dispatch, arrival at local sorting hubs, and out-of-delivery alerts.
Extended Transit Adjustments: If a delivery exceeds the standard estimated transit window, we will launch a formal investigation with the respective carrier. We pledge to resolve or provide a definitive resolution (including a reshipment or a full reimbursement) within 14 business days from the commencement of the investigation.
Transfer of Risk: Pursuant to the EU Consumer Rights Directive, the risk of loss or damage to the goods passes to you only when you, or a third party designated by you (other than the carrier), have acquired physical possession of the goods.
- Right of Withdrawal (14-Day Cancellation Period)
As a consumer residing within the European Union/European Economic Area, you possess a statutory right to withdraw from this contract within 14 days without giving any reason.
Withdrawal Period: The withdrawal period expires 14 days from the day on which you, or a third party nominated by you, acquire physical possession of the goods.
Exercise of Right: To exercise your right of withdrawal, you must inform us of your decision via an explicit declaration sent by email to flowerpot@glazenestpot.com.
Effects of Withdrawal: If you withdraw from this contract, we will reimburse all payments received from you for the specified order, including delivery costs (with the exception of supplementary costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day we receive your notification of withdrawal. We will carry out such reimbursement using the same means of payment as you used for the initial transaction.
- Damaged, Defective, or Non-Conforming Goods
We adhere strictly to statutory European warranty laws ensuring that goods must conform with the sales contract.
Reporting Faults: If you receive an item that is defective, structurally compromised, or damaged during transit, please contact our customer support team immediately at flowerpot@glazenestpot.com.
Evidence and Resolution: To expedite your claim, please provide photographic evidence illustrating the specific defect or damage. Upon verification, we will process either a full refund or dispatch a replacement item.
Return Determination: For verified transit damage or product defects, ANIMA Garden GmbH reserves the right to determine, on a case-by-case basis, whether the physical return of the damaged item is required. If a return is waived, it will only be executed after our formal approval of the provided photographic evidence.
- Prices, Payment, and Cancellations
Pricing and Tax: All prices listed on the Website are stated in Euros (€) and are inclusive of any applicable statutory Value Added Tax (VAT) in accordance with German and European tax regulations.
Payment Terms: Payment must be made via the secure methods specified at checkout. The total contract price is due immediately upon the conclusion of the checkout process.
Order Cancellations & Unauthorized Transactions: If you notice an unauthorized transaction or made an error in your order, please contact us immediately at flowerpot@glazenestpot.com. Cancellations or modifications can only be processed prior to order dispatch (within our 1-2 business day processing window). Once an order has been handed over to the logistics partner, the order cannot be canceled, and the customer must utilize the standard statutory 14-day right of withdrawal upon delivery.
- Limitation of Liability
We accept full liability for damages arising from intent, gross negligence, or a breach of material contractual obligations (cardinal duties) necessary for the performance of the contract.
In the event of a minor negligent breach of a material contractual obligation, our liability is strictly limited to foreseeable damages typical for this type of contract.
Nothing in these Terms limits or excludes our liability for death or personal injury resulting from negligence, or for fraudulent misrepresentation, in compliance with applicable local statutory laws.
- Governing Law and Dispute Resolution
These Terms and all purchase agreements concluded under them shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.
